Stealthy Hosting Inc provides quality hosting services to clients from all around the world; the following terms and conditions have been put in place to ensure that this quality is maintained.

Content

All services provided by Stealthy Hosting Inc may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless Stealthy Hosting from any claims resulting from the use of the service that damages the subscriber or any other party.

Examples of Non-Acceptable Content or Links

• Pirated software
• "Illegal MP3's"
• Hackers programs or archives
• Warez Sites
• Illegal Pornography
• Proxies

Proxies may be permitted if permission is granted by support.
Stealthy Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Chat Rooms

Stealthy Hosting Inc does allow our clients to install their own chat rooms. However, these tend to be large system hogs and may fall into the usage limitations clause. You are free to run your own chat script, as long as it does not hinder server performance.

IRC, Telnet & SSH

Stealthy Hosting Inc does not allow IRC or IRC bots to be operated on our servers. Hosting any sort of IRC channel, bot, or relay will result in the immediate termination of your account without refund. Anyone found hosting such files will be held financially responsible for any damage caused to our servers..

Please contact our support department to request SSH access. All SSH activity is logged and reviewed frequently. Access may be revoked at any time.

Spamming

Spamming, or the sending of unsolicited email, from an Stealthy Hosting server or using an email address that is maintained on an Stealthy Hosting machine, is STRICTLY prohibited. Stealthy Hosting will be the sole arbiter as to what constitutes a violation of this provision. Opt-In email is acceptable, as long as opt-out/removal request are fully honored. Please make an effort to limit outgoing mail on your account to no more than 600 pieces per hour. Large mailings are preferred to be sent from the hours of 12AM - 5AM Central Time.

Server Abuse

Any attempts, whether intentional or accidental (runaway processes or excessive resource usage caused by poorly written scripts), to undermine or cause harm to an Stealthy Hosting server or customer of Stealthy Hosting is strictly prohibited. Stealthy Hosting may terminate any account believed to be abusing the network without warning. Web-based games are allowed on our server; however, if these games affect the performance of the entire server, we reserve the right to suspend the account. If the web-based game results in 2 or more account suspensions based on excessive resource usage, we WILL terminate the account without a refund.

Data Security & Backups

Data stored on the internet is not secure; even the most complex of password protection or encryption services can be hacked. You are responsible for protecting sensitive data, and under no circumstances should confidential information such as credit card numbers be stored on your hosting account. Although steps are taken to create backup copies of data stored on Stealthy Hosting Inc servers, we do not guarantee the security of your data in unforeseen events such as a server being hacked. You are responsible for creating backup copies of your work so that it may be restored in an emergency. In the event of a problem backups may be provided to the client if a backup exists, do not rely on this service for your critical data.

Suspension/De-Activation

Violation of these terms and conditions is grounds for account suspension or de-activation. Stealthy Hosting Inc reserves the right to remove any account without prior notice. If Stealthy Hosting Inc deactivates your account(s) for violating our TOS, your will forfeit your rights to a refund. Warnings will be issued in most cases, but more serious violations can result in immediate suspension or termination of the account. Stealthy Hosting is not responsible for data integrity, regardless of circumstance. Limestone Networks strongly recommends keeping up to date and off network backups to protect against data loss. A 10% late fee will be added to all overdue invoices.

30-day Free Refund(Shared Hosting)

With each hosting account comes an incredible piece of mind; you can request a complete refund within the first 30 days of service if you are not completely satisfied. However, if you decide that you would like to cancel your service, you must contact a customer service representative WITHIN 30 days from the signup date for your service. If you wish to keep the service, no action is required on your part; our system will continue billing you after the 30 day refund period unless you cancel within that time. If you violate any portion of this TOS/AUP, you immediately forfeit your right to claim a refund.

7-day Free Refund(Dedicated Servers)

Dedicated servers have a 7 day refund period if you are not satisfied with our services. However, if you decide that you would like to cancel your service, you must contact a customer service representative WITHIN 7 days from the signup date for your service. If you wish to keep the service, no action is required on your part.

Refunds/Charge-Backs

No Services rendered by Stealthy Hosting are eligible for a refund (except what is implied above). Prepayments and account credit are ineligible to be refunded, or transferred to alternate accounts. Any and all charge disputes must be reported directly to Stealthy Hosting within thirty (30) days of the date which the charge originally occurred. If a charge which is deemed valid by Stealthy Hosting, and validated by our Terms of Service, is disputed to a financial institution by performing a charge-back, then the client agrees to pay an 'Administrative Fee' of $200 in addition to original amount of funds which were reclaimed.

Changes To This TOS/AUP

Stealthy Hosting reserves the right to change this TOS without warning, though major changes may be communicated via e-mail.
